Announcement on the implementation of the procedure for collecting bids by public announcement 4

Based on the Decision of the Municipal Council of the Municipality of Bogatić No. 06-2-460/2023-01 dated January 18, 2023, the Commission for the implementation of the procedure for the disposal of construction land in the process of public advertising, through the collection of written bids, announces the Announcement on the implementation of the procedure, for giving for lease of construction land under the following conditions:

– FOR LEASE for a fee, part of cat. plot no. 5341 KO Crna Bara in an area of 0.01.00 ha registered in the real estate register no. 223 for KO Crna Bara, which has a total area of 0.26.75 ha.

– cat. lot no. 5341 was registered in the Property Register no. 223 KO Crna Bara, which according to culture is the land under the building and other facilities and which is the public property of the Municipality of Bogatić.

– part of plot no. 5341 is leased in an area of 0.01.00 ha exclusively for setting up and installing a base radio station, associated equipment and devices, antenna poles, antennas and transmission systems and other equipment and devices necessary for construction, functioning , exploitation and maintenance of the radio-mobile telephony system, which is demountable in nature,

– the part of the plot of land that is leased is taken in the condition seen, and the lessee is obliged to return it to the condition in which he received it, free of belongings and equipment,

– the initial price of the monthly rent is 13,050.00 dinars, i.e. the annual rent is 156,600.00 dinars, as long as it is paid in full for the agreed lease term, within 15 days from the date of conclusion of the lease agreement

– the tenant’s obligation to pay the costs of water, electricity, utilities, telephone and other costs of the use of the plot of land according to the invoices issued, if they arise from the use of part of the plot of land,

– part of floor plot no. 5341 KO Crna Bara is leased in the condition seen, for a certain period of time, for a period of 1 (one) year from the date of conclusion of the lease agreement,

– in the event that the future tenant is also the previous tenant, the lease agreement will run from December 1, 2022, taking into account the fact that the previous tenant did not leave the lease after the expiration of the previous agreement, which lasted until November 30, 2022

– participants of the public announcement can be all legal entities and all natural persons,

– members of the Commission and their deputies may not participate in the public advertising procedure,

– a participant in public advertising cannot be a person who has not paid his obligations to the Municipality based on the lease, i.e. alienation of construction land, fees for the development of construction land and fees for the use of construction land, as well as a person with whom the lease contract has been terminated, i.e. with whom the lease contract has been canceled, that is, a contract of alienation due to non-fulfillment of obligations from the contract within 5 years from the date of termination or cancellation,

– the orderly offer contains the following information:

– about the tenderer and for natural persons: first and last name, unique citizen registration number and residential address,

– for legal entities and entrepreneurs: name or business name, tax identification number and registered office.

– a visible indication of which cadastral parcel the offer refers to,

– proper authorization for representation, if the applicant does not personally approach the opening of bids,

– proof of payment of the guarantee amount (deposit),

– photocopy of the identity card-document for natural persons,

– a decision on registration in the Register of Business Entities or another appropriate register,

– declaration of acceptance of the terms of the ad

– the offered price, i.e. the offered amount of rent for construction land,

– participants of the public advertisement are obliged to pay a deposit in the amount of 20% of the initial fee (31,320.00 dinars) in order to participate in the bidding process, and the same is returned to the participants who are unsuccessful in the bidding, after the conclusion of the contract.

– if the future tenant does not sign the lease agreement, the deposited deposit will not be returned and a new advertisement will be published,

– an indication of the real estate for which it is applied for public advertising, through the collection of bids (if the advertisement is for a larger number of real estates),

– the deadline for submitting bids is February 27, 2023. years,

– offers are submitted in a sealed envelope by registered mail to the address of the Municipal Administration of the Municipality of Bogatić, Commission for the Implementation of the Construction Land Disposal Procedure, ul. M. Vitomirovića No. 1 or through the office of the Municipal Administration of Bogatić, with a visible indication of which cadastral plot it refers to,

– the deposit for participation in the procedure of collecting written bids is paid to the account of the Budget of the Municipality of Bogatić number 840-291804-44, and the purpose of the payment is the deposit for participation in the public advertisement for part cat.parc.no.5341,

– an untimely or irregular offer is rejected,

– an untimely offer is one that was submitted after the deadline for submitting offers,

– an irregular offer is one that is submitted in an open envelope or without a visible indication of which individual cadastral parcel it refers to, that does not contain the data and proper documents from Article 17 of this decision

– the procedure for opening timely and orderly bids will be carried out on March 2, 2023. starting at 11:00 a.m. in the small hall of the Municipality of Bogatić on the first floor in M. Vitomirovića Street No. 1,

– the procedure for collecting bids through a public advertisement is considered successful, if at least one timely and orderly bid is received and if the participant accepts the initial rent amount, which is also the most favorable amount

– the deposit will be returned to the participants of the public tender who do not succeed in the tender after submitting the current account number if they do not submit it together with the offer,

– the decision on the selection of the most favorable bidder is made by the president of the Municipality of Bogatić, based on the report of the Commission on the procedure carried out

– publish the ad in the media, on the website of the Municipality of Bogatić, on the notice board of the Crna Bara Municipality and on the notice board of the Municipality of Bogatić.
